1. Agreement to these Terms
These Terms form an agreement between you and ADO Mobility (ADO, we, us or our). By using our services, creating an account, requesting a ride, registering as a partner or communicating with us, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the services.
Additional service, partner, business-account, promotion or payment terms may apply. If they conflict with these Terms, the additional terms control for that service.
2. Our role
ADO provides a technology platform that may enable riders, driver partners and other service providers to find and arrange mobility services. Unless we expressly state otherwise, transport is provided by independent driver partners, not ADO. ADO does not guarantee the availability, identity, conduct, quality, safety, suitability or timeliness of a partner or ride.
3. Eligibility, accounts and acceptable use
- You must be legally able to enter into these Terms and provide accurate, current information.
- You are responsible for safeguarding your account, device and verification codes, and activity through your account.
- Use the services lawfully and respectfully. Do not endanger, harass, discriminate against, threaten, defraud or abuse others.
- Do not interfere with the platform; scrape, reverse engineer, bypass security, create false accounts, manipulate ratings, transmit malware or use the services for unlawful activity.
We may suspend, restrict or terminate access where we reasonably believe these Terms, law or safety requirements have been breached.
4. Ride requests, pricing and payment
A ride request is subject to partner availability and acceptance. Estimates, arrival times, routes and prices can change because of traffic, route changes, waiting time, tolls, taxes, surcharges, service changes or other operational factors. An estimate is not a promise that a ride will be available or completed.
You agree to pay all charges associated with your requested service, including applicable taxes, tolls, waiting charges, cancellation charges and reasonably assessed damage or cleaning charges. Payment may be handled by third-party providers. Cancellations, refunds and disputes are subject to applicable policies shown when you use the service.
5. Safety and conduct
- Follow applicable laws, wear a seat belt where available and follow reasonable safety directions.
- Do not carry prohibited, illegal, hazardous or unsafe items, exceed vehicle capacity or cause vehicle damage.
- Treat everyone with dignity. Harassment, discrimination, violence, threats, intoxicated or dangerous conduct can result in removal and reporting to authorities where appropriate.
- Call emergency services for immediate danger. ADO support and location features are not a substitute for emergency services.
We may share information with relevant parties to investigate safety incidents, claims or suspected misconduct, consistent with law and our Privacy Policy.
6. Driver partners
Partner access is subject to separate onboarding, verification and partner terms. Partners must maintain required licences, permits, registrations, insurance, vehicle fitness and legal compliance, and provide truthful information. Partners are responsible for their own tax, insurance and operating obligations unless agreed in writing.
Partner location, availability and vehicle information may be displayed to eligible customers to enable ride matching and acceptance, as described in our Privacy Policy. Partners must use rider information only to perform a legitimate ADO-related service and must not retain, contact or track riders outside that purpose.
7. Intellectual property and feedback
ADO and its licensors own the services, branding, software, content and related intellectual-property rights. We grant you a limited, personal, revocable and non-transferable right to use the services for their intended purpose. If you provide feedback, ratings, reviews or other content, you grant ADO a non-exclusive, worldwide, royalty-free licence to use it to operate, improve and promote the services, subject to applicable law and our Privacy Policy.
8. Disclaimers and limitation of liability
To the extent permitted by law, services are provided as is and as available without warranties of any kind. We do not warrant uninterrupted availability, error-free operation, security, estimate accuracy or that a requested partner or ride will be available.
To the extent permitted by law, ADO will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or loss of profits, data, goodwill or opportunity arising from use of the services. Nothing excludes liability that cannot be excluded under applicable law.
9. Indemnity, termination and governing law
To the extent permitted by law, you will indemnify ADO, its affiliates and personnel from claims, losses, liabilities and expenses arising from your breach, unlawful conduct, misuse or infringement of another person’s rights. You may stop using the services at any time. We may suspend or terminate access where reasonably necessary for safety, security, legal compliance, fraud prevention, operational reasons or a breach of these Terms.
These Terms are governed by the laws of India. Courts with competent jurisdiction in Itanagar, Arunachal Pradesh will have exclusive jurisdiction, except where applicable law provides otherwise. We may update these Terms; continued use after their effective date means acceptance to the extent permitted by law.
